By installing, accessing, or using ChatCast ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
ChatCast is operated by Mojo Digital ME ("we", "our", or "us"). These Terms apply to all users, including merchants, agents, and administrators.
2. Description of Service
ChatCast is an omnichannel customer support platform for Shopify merchants. The Service allows you to:
- Manage customer conversations from WhatsApp, Instagram, Messenger, and Email in one inbox
- View customer context from your Shopify store
- Use AI-powered reply suggestions
- Set up automated messages and workflows
- Collaborate with team members
3. Account Requirements
To use ChatCast, you must:
- Have an active Shopify store
- Be at least 18 years of age
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Comply with all applicable laws and regulations
4. Acceptable Use
You agree NOT to use the Service to:
- Send spam, unsolicited messages, or promotional content without consent
- Harass, abuse, or harm others
- Violate any applicable laws or regulations
- Infringe on intellectual property rights
- Transmit viruses, malware, or harmful code
- Attempt to gain unauthorized access to the Service
- Use the Service for any illegal or fraudulent purposes
5. Third-Party Integrations
ChatCast integrates with third-party services including Shopify, Meta (Facebook/Instagram), WhatsApp (via Gupshup), and OpenAI. Your use of these integrations is subject to:
- Shopify's Terms of Service and API License Agreement
- Meta Platform Terms and Policies
- WhatsApp Business Terms of Service
- OpenAI's Usage Policies
We are not responsible for the availability, accuracy, or security of third-party services.
6. Billing and Payments
ChatCast offers various pricing plans billed through Shopify's billing system. By selecting a paid plan, you agree to:
- Pay all fees associated with your selected plan
- Provide accurate billing information
- Accept automatic renewal of subscriptions
Usage-based charges (e.g., AI suggestion credits) are billed according to your consumption. Price changes will be communicated 30 days in advance.
7. Data and Privacy
Your use of ChatCast is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the Service, you consent to our data practices as described in the Privacy Policy.
8. Intellectual Property
ChatCast and its original content, features, and functionality are owned by Mojo Digital ME and are protected by international copyright, trademark, and other intellectual property laws.
You retain ownership of all content you submit through the Service. By submitting content, you grant us a license to use, store, and display that content as necessary to provide the Service.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHATCAST AND MOJO DIGITAL ME SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, data, or business opportunities
- Service interruptions or downtime
- Actions of third-party services or integrations
Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
11. Termination
You may terminate your use of ChatCast at any time by uninstalling the app from your Shopify store.
We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice, effective immediately. Reasons for termination include, but are not limited to, violation of these Terms or applicable laws.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the new Terms on this page and updating the "Last updated" date. Continued use of the Service after such changes constitutes acceptance of the new Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates, without regard to its conflict of law provisions.
